A past client of Tabor Law Firm was driving his Harley Davidson motorcycle down a scenic rural road on June 21, 2009, when the Defendant was traveling in the opposite direction on Dutch Hollow Road in Aurora Indiana. The Defendant was traveling approximately 45 mph, in excess of the posted speed limit, in his Chevrolet Corvette when he rounded a corner of the road, went through a dip in the road followed by a rise, at which point he and our client were headed straight towards each other. A collision ensued between our client and the defendant’s vehicles, and our client was ejected from his motorcycle. Our then slid down the road and sustained fatal injuries. He was pronounced dead at the seen by emergency responders. The Defendant claimed he didn’t have time to stop or slow to avoid hitting the plaintiff, however, Tabor Law’s accident reconstruction investigation proved otherwise. The Defendant also registered a .09 blood alcohol level, and was arrested for Operating While Intoxicated. The police accident reconstructionist on the scene, ISP Trooper Jason Hankins, attributed the accident to three causes: 1) The Defendant traveling at an unsafe speed in excess of the posted speed limit; 2) The Defendant’s intoxication and the resulting impairment to his reaction time, and 3) The vehicle’s positioning on the narrow stretch of road. Our client’s tragic death left behind his wife, then 30 years old, and his two children, then ages six and four. Tabor Law Firm was able to change the mind of the liability insurer in what was initially a “no offer” case. Ultimately, Tabor Law was able to obtain a $525,000 settlement for the family that will provide financial assistance to our client’s wife and children.
